Subject to the Copyright Act. 1968 (as amended), permission is granted only to the purchaser/buyer to print the amount required for the single specific event in the order for his/her personal individual use of the artwork(s)/final products/printables issued as specified in the copyright and terms of service and are subject to the following restrictions:
- - The origin of this must not be misrepresented; you must not claim that you wrote/created the original product/artwork(s).
- - If you use this artwork(s)/final product/printables, an acknowledgement in the use would be appreciated but is not a requirement.
- - The buyer/purchaser is only purchasing the use of the artwork(s)/final product for a single specific event. This transaction does not buy ownership of the artwork(s)/final product/printables.
- - The buyer/purchaser is not permitted to alter, repacked and/or sell artwork(s)/final product/printables without the written permission of MissCreative Design Studio.
- - This notice may not be removed or altered from any distribution.
In addition, as the owner/manager of MissCreative Design Studio, I verify that I have the right to authorize the use of MissCreative artwork(s)/final products/ printables within these conditions of use.
Refund & Remedies - Services
We are confident that you will be happy with the quality of our products and stand behind every single item. However, if you are not satisfied with a product for any reason, please contact us within 7 days ofreceiving your order to initiate an exchange or return refund.
MissCreative Design Studio's Refund Policy is taken direct from the Office of Fair Trading Queensland for businesses providing a service to their clients and is as follows:
We are not required to provide a refund if you change your mind about the services you asked for.
But you can choose to cancel your contract, and receive a refund for unconsumed services, if the service has a major problem. This is when the service:
- - Has a problem that would have stopped someone from purchasing the service if they had known about it
- - Is substantially unfit for its common purpose, and can't be easily fixed within a reasonable time
- - Does not meet the specific purpose you asked for and cannot be easily rectified within a reasonable time
- - Creates an unsafe situation
If you choose to continue with the contract, you can ask us to compensate you for any difference in the value of the services we provided and what you paid. If the problem is not major, we will fix it within a reasonable time. If it is not fixed within this time, you can choose to have someone else fix the problem and recover all reasonable costs from us. If the problem cannot be fixed, we view it as a major problem.
Please keep proof of your agreement - e.g. your invoice or quote.
Payment Options
Prices are in Australian dollars. Prices are subject to change without notice. Payment can be made by PayPal, Secure online Credit Card processing or internet banking transfer. Full payment is required prior to the processing of your order. An invoice will be emailed to you once your order is placed.
Communication
The staff at MissCreative Design Studio will not endure hostile, abrupt or disgruntled communications/interactions with their clients. All communications and interactions between The Design Staff and Clients are to be done in a professional and safe manner to produce top quality products for our clients. Cyber bullying is highly inexcusable and will be reported to the authorities if necessary. Miss Creative Design Studio has the right to refuse and cancel orders at any time in which either party feels threatened or vulnerable.
Artwork & Photograph Requirements
MissCreative Design Studio will provide a final proof of your design. It is the responsibility of the customer to ensure all text, photos and content are correct. MissCreative Design Studio does not take responsibility for customer omissions or errors. Spelling and punctuation checks are the sole responsibility of the customer.
Due to varying colour calibrations of printers and monitors, variations will occur between the design on a monitor and the finished product. The purchaser accepts the risk of such differences. We recommend using high resolution digital or scanned images on our photo/image upload products. Photos should be 300dpi to produce an optimal result. Low-resolution images of 300dpi or less will produce an inferior result. We do not reproduce on photographic paper, therefore your photos will not look exactly like a glossy photo and they are printed on satin card and will print slightly darker. If in doubt about your photo, we can lighten this if advised. We highly recommend ordering a sample of our products tsee colours and quality before placing your personalised order.
You must be the copyright owner of all images uploaded/supplied to MissCreative Design Studio. If you are not the copyright owner, you are required to obtain the rights to reproduce the images from the copyright owner in writing. If you are unsure of who the copyright owner is, please do not use the photo. MissCreative Design Studio takes
no responsibility for the files uploaded. By using this site, you agree to hold harmless MissCreative Design Studio for all costs, expenses, attorney's fees or judgments resulting from any claims or lawsuit made against MissCreative Design Studio for any grounds claiming that the work produced violates any copyright or proprietary right of any person or entity.
MissCreative Design Studio reserves the right to reject any orders.
Artwork Approval Contract
MissCreative Design Studio operates an internal quality control system in order to maintain the very highest standards of customer care in the supply of custom made artwork, invitations, printables and designs. As part of our quality standards processes it is our policy to have your signed approval on all proofs prior to commencing your order. This form will be emailed to you with your proof.
Cancellations
If you would like to cancel your order once a proof has already been supplied, we will refund your order total minus a $25 processing/design fee. Cancellations on orders after production has commenced and approval has been received will incur a $50 processing/design/production fee.
Errors
We pride ourselves in our detail and precision put into each individual item. However, occasionally an error may occur by fault of either the Client or us, MissCreative Design Studio.
Due to the personalized nature of our products, we cannot accept returns based on customer input errors (e.g., typos, layout) or simply if a customer changes their mind or is not happy with the colour. Due to varying colour calibrations of printers and monitors, variations will occur between the design on a monitor and the finished product. The purchaser accepts the risk of such differences.If the error is due to fault on our behalf, please accept our sincere apologies. Once notified of our error, we will offer you a full refund, credit towards future purchase or complete exchange with the quickest shipping option possible. If you select a full refund, we ask that you please return the order in its original form and packaging. We will issue a refund as soon as we receive the shipment. We reserve the right to reject any returns and exchanges that do not meet these conditions.
Changes/Alterations
If you require changes to be made to your order and printing has commenced, a reprint charge of the total order amount will apply minus shipping costs. If you require changes to your order after you have approved a proof online, you will be charged a $20.00 design fee
